GENERAL

By using the Wellness Family Method service, you (“You”) agree to be bound by the following Terms of Service (“TOS”). These TOS may be updated from time to time at the discretion of Wellness Family Method, and you will be notified of any changes via email. Your login into our system signifies your acceptance of these Terms of Service.

DESCRIPTION OF PRODUCTS & SERVICE

Wellness Family Method offers an innovative method for transmitting information via SMS text messages through an easy-to-use website (the “Service”). By using the Service, you agree to receive certain communications from Wellness Family Method via email, which may include service announcements and administrative messages, and are considered part of your membership. Any new features that improve or expand the current Service will also be subject to these TOS. Please note that the Service is provided on an “AS-IS” basis, and you are responsible for obtaining access to it, which may involve additional fees like internet service provider or airtime charges. You are also responsible for providing the necessary equipment to access the Service.

WELLNESS FAMILY METHOD PRIVACY POLICY

To set up your account, you must provide certain information to Wellness Family Method. Rest assured that your information will never be released to anyone without your prior approval, unless required by law. As part of the service, Wellness Family Method collects the phone numbers of prospective members accessing information via text messages (SMS), and these phone numbers will never be shared.

MEMBER ACCOUNT, PASSWORD AND SECURITY

Upon completing the registration process, you will receive a password and account designation. It is your responsibility to maintain the confidentiality of your password and account, and you are fully responsible for all activities that occur under your account. If you suspect any unauthorized use or breach of security, you must inform Wellness Family Method immediately. Failure to comply with this may lead to loss or damage for which Wellness Family Method is not liable.

MEMBER CONDUCT

You acknowledge that Wellness Family Method may access, preserve, and disclose your account information and content if required by law or in good faith belief to protect the rights, property, or safety of Wellness Family Method, its users, and the public. The Service’s technical processing and transmission may involve changes to conform to the technical requirements of connecting networks or devices. The materials provided on the Service are protected by usage rules set by Wellness Family Method, and any unauthorized reproduction or distribution is strictly prohibited.

INDEMNITY

By subscribing to Wellness Family Method or using its services, you agree to defend, indemnify, and hold Wellness Family Method, its officers, agents, and employees harmless from any claim, complaint, demand, or lawsuit, including reasonable attorneys’ fees, arising from your subscription or use of the services.

NO RESALE OF SERVICE

The Wellness Family Method service is non-transferable, and you may not reproduce, duplicate, sell, trade, resell, or exploit any portion of the Service for commercial purposes.

MODIFICATIONS TO SERVICE

Wellness Family Method reserves the right to modify or discontinue the Service, either temporarily or permanently, with or without notice.

TERMINATION

Wellness Family Method may terminate your account and access to the Service under certain circumstances and without prior notice, including breaches of the TOS, requests by law enforcement or government agencies, discontinuance of the Service, or fraudulent/illegal activities. Termination may involve deleting your password and all related information, barring further use of the Service.

WELLNESS FAMILY METHOD PROPRIETARY RIGHTS

The Service and the associated software contain proprietary and confidential information protected by intellectual property laws. You agree not to modify, rent, sell, distribute, or create derivative works based on the Service or the Software, except as expressly authorized by Wellness Family Method.

DISCLAIMER OF WARRANTIES

Your use of the Service is at your sole risk, and Wellness Family Method expressly disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Wellness Family Method makes no warranty regarding uninterrupted, timely, secure, or error-free Service, accurate results, or correction of software errors. If you have an epileptic condition, consult your physician before using the Service, as it may induce seizures in some users.

LIMITATION OF LIABILITY

Wellness Family Method shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the Service, including the cost of substitute goods and services.

EXCLUSIONS AND LIMITATIONS

Certain jurisdictions may not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, in which case some of the above limitations may not apply to you.

NOTICE

Wellness Family Method may provide you with notices, including changes to the TOS, through email, regular mail, or postings on the Service.

TRADEMARK INFORMATION

You may use Wellness Family Method’s trademarks on advertising and marketing campaigns with permission from Wellness Family Method.

GENERAL INFORMATION

The TOS constitute the entire agreement between you and Wellness Family Method, governing your use of the Service and superseding any prior agreements. The TOS and your relationship with Wellness Family Method are governed by the laws of the State of Texas, with exclusive jurisdiction in Texas courts. The failure to exercise or enforce any right or provision of the TOS does not constitute a waiver, and if any provision is found invalid, the other provisions remain in effect. Your Wellness Family Method account is non-transferable, and any rights to it terminate upon your death. Claims or actions related to the Service must be filed within one year after the claim arises. Section titles in the TOS are for convenience and have no legal effect.
