Limitations on Use:

To register for and use the Wellness Family Method Club service, you must be at least 17 years old. If you are under 17 years old, please obtain permission from your parents or legal guardians before signing up for the Wellness Family Method Club service.

Please be aware that mobile carriers are not responsible for delayed or undelivered messages. Participating carriers include T-Mobile®, Verizon Wireless, AT&T, Sprint, Boost, U.S. Cellular®, MetroPCS, Virgin Mobile, and Cricket.

Support Issues, Canceling, or Unsubscribing:

If you wish to opt-out of the Wellness Family Method Club service at any time, you can do so by texting STOP, QUIT, END, CANCEL, UNSUBSCRIBE, or STOP ALL to {Insert Program Code}. Ownership; Trademarks; Modifications to Offers:

By using the Wellness Family Method Club services and any offers provided through it, you agree that Wellness Family Method or its partners will retain all legal rights, titles, and interests, including any intellectual property rights. You are not allowed to alter or modify any offers made through the Wellness Family Method Club service, and you must not remove, obscure, or alter any proprietary rights notices (such as copyright or trademark notices) affixed to the Wellness Family Method Club services or offers. Unless expressly authorized by a partner, you agree not to use any Trademark, service mark, trade name, or logo (“Trademarks”) of any entity in a way that may cause confusion about Trademark ownership or be detrimental to the goodwill of such Trademarks.

Disclaimer of Warranties:

The Wellness Family Method Club service is provided “as is” and “as available,” and Wellness Family Method provides no warranties, express or implied, regarding the service. This includes but is not limited to any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Factors beyond Wellness Family Method’s control, such as mobile carrier network speed and internet performance, may affect the service’s performance, and Wellness Family Method is not responsible for any acts beyond its control.

Limitation of Liability:

Under no circumstances shall Wellness Family Method, its officers, directors, employees, or agents be liable to you for any damages whatsoever arising from your use of the Wellness Family Method Club service. This includes direct, indirect, incidental, consequential, exemplary, or special damages, even if advised of the possibility of such damages. If applicable law prohibits any disclaimer or limitation on damages or liability set forth herein in a particular circumstance, Wellness Family Method shall be entitled to the maximum disclaimers and/or limitations on damages and liability available by such applicable law in that particular circumstance. However, in no event shall Wellness Family Method’s liability for damages arising under these Terms of Use or your use of the Wellness Family Method Club service exceed US $500.

Indemnity:

You agree to indemnify and hold each Company party harmless from any claim or demand, and any damages, costs, or expenses arising in connection with such claim or demand, including reasonable attorneys’ fees and costs, made by any other party due to or arising out of your breach of this agreement or the documents it incorporates by reference, or your violation of any law or the right of another party.

Governing Law; Venue:

This agreement and its validity, construction, and performance will be governed in all respects by the laws of the state of Texas, without regard to its choice of law provisions. You irrevocably agree to accept the exclusive personal jurisdiction and waive any objections to the venue of such courts.
